1. The promoter is: ROCKWEAR International Pty Ltd (ABN 70 005 612 537) of 55 Mentmore Ave ROSEBERY NSW, 2018

2. Entry is open to all Australian residents over the age of 18 years. To enter, use this link: https://give.nbcf.org.au/careforyourpair/. Employees and their immediate families of Rockwear International Pty Ltd are not eligible to receive the prize but are welcome to make donations. 

3. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.

4. No responsibility can be accepted for entries not received for whatever reason.

5. Multiple entries per person will be accepted and identified by a unique receipt number. In the event of multiple entries from the same individual, all entry and receipt numbers will be valid.

6. Opening date for entry will be Thursday 15th May 2025. Closing date for entry will be 11:59 PM AEDT on Wednesday 21st May 2025. After this date no further entries to the competition will be permitted.

7. The rules of the competition and how to enter are as follows:

8. The prize is as follows:

• - 1 of 5 Rockwear Pink Collection prize pack valued at $419.94.

 

9. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize. The prize is not exchangeable or redeemable for cash or other goods or services. The National Breast Cancer Foundation will not be liable for any loss, damage or personal injury whatsoever (including but not limited) to direct, indirect and consequential loss suffered or sustained in connection with this competition, the promotion of this competition or the use of any prize.

How will the winners be drawn?

10. The winning entry will be drawn randomly on Thursday 29th May 2025.  The first valid entry drawn will win the prize listed above. The location of the draw will be Rockwear, 55 Mentmore St, Roseberry, NSW, 2018

How will the winner be notified?

11. A Rockwear representative will notify the winner within two working days of the draw. Three call attempts will be made in total, and an email will follow. The winner’s address must be confirmed before the prizes can be sent by courier. The prize will be sent from Rockwear International Pty Ltd. If the prize is not accepted or claimed by Thursday 5th June, the prize will be forfeited by the winner. A redraw will be conducted on Friday 6th June at the same location as the original draw.

12. The promoter’s decision in respect of all matters to do with the competition will be https://nbcf.org.au/ final and no correspondence will be entered into.

13. The competition and these terms and conditions will be governed by Australian law.

14. The winner agrees to the use of his/her name and image in any publicity material, as well as their entry.

From Monday November 11th 2024 at 9AM AEST to Monday December 2nd 2024 at 11:59PM AEST.
 

Item 6: Entrant Restrictions

In order to be able to enter the promotion, entrants must be resident in Australia and be aged 18 years or older at the time of entry. Employees of the Promoter, its related body corporates, suppliers, distributors and advertising and promotional agencies, and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are ineligible to enter. Entrants are required to provide their email address & to opt in to receive marketing communications. This email address will be used to notify the winner.
 

Item 7: Method of Entry

Information on how to enter and prizes form part of these terms and conditions. Submission of an entry is deemed acceptance of these terms and conditions. To enter, during the Promotion Period entrants need to:

1. Make any single transaction during the campaign period, create or use an existing Rockwear Account and be opted in to marketing communications on the day of the draw. A valid email address is required for competition entry. 

2. If a customer is making a purchase in store and is an existing customer of the Promoter and is already opted in to receive marketing materials from the Promoter, that customer will automatically be entered into the Promotion.

3. If a customer is making a purchase in store and is an existing customer of the Promoter and has not opted in to receive the marketing materials from the Promoter, then upon compliance with 1 above and opting in to receive marketing materials from the Promoter, that entrant will be entered into the Promotion.

4. If an entrant is making a purchase online via the https://www.rockwear.com.au/ Website, then upon compliance with 1 above and at the checkout page of the Website the entrant is required to: 

(a) enter details including their name and email address; 

(b) Opt in to receive marketing materials from the Promoter. 

The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Incomplete, indecipherable or illegible entries will be deemed invalid.

Only one entry per person is valid during the competition period. 

Entrants must retain their original purchase receipt for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in the invalidation of all of an entrant’s entries and forfeiture of any right to a prize. 

Item 8: Winner Selection

The first 20 valid entries drawn at random from all valid entries received during the Promotion Period will win the Prize. The draw will take place at the Promoter's offices at 55 Mentmore Avenue, Rosebery NSW 2018 on Friday December 6th 2024 at 11am.

The Promoter’s decision is final and no correspondence will be entered into.
 

Item 9: Prize

The Prize is a share of AUD $10,000 cash. In the form of 20 (twenty) X $500 Visa Gift Cards.

Item 10:  Prize Winner Publication, Notification and Delivery

The winners will be notified by email on the same day of the draw. Notification will be provided to the winner using the email address provided to the Promoter during the entry process. The notification email will request that the winner provide to the Promoter within 14 days the details of the winner's nominated postal address where the Prizes will be sent via registered mail.

Unless the winner requests that their details not be published, the first initial, surname and postcode of the winners will be published on the Website within 14 days of winning.

Subject to the unclaimed prize draw, if for any reason whatsoever the winner does not claim the Prize by the time stipulated by the Promoter (9AM - Friday 20th December 2024, 14 days after initial notification), then the Prize will be forfeited by the winner.

Item 11: Unclaimed Prize Draw

In the event a winner does not respond to the Promoter's email within 14 days and provide their postal address, the Prize will be deemed unclaimed and subject to any directions from a regulatory authority, the Promoter will conduct a further random draw from all remaining valid entries to determine the unclaimed prize winner. 

The draw will take place at the Promoter's offices at 55 Mentmore Avenue, Rosebery NSW 2018, on 20 December 2024 at 11am AEDT. The unclaimed prize winner will be notified by email on the same day as the unclaimed prize draw. Notification will be provided to the unclaimed prize winner using the email address provided to the Promoter during the entry process. The notification email will request that the unclaimed prize winner provide to the Promoter within 14 days the details of the winner's nominated postal address.

Unless the unclaimed prize winner requests that their details not be published, details of the first initial, surname and postcode of the unclaimed prize winner will be published on the Website within 14 days of winning. 

Item 12: Use of Personal Information

In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and regulatory authorities. Participation in the Promotion is conditional on providing this information, the entrants first name, email address, email opt-in. Entrant’s personal information will be used in relation to the conduct of the Promotion and delivery of the Prize to the winner (or unclaimed prize winner as the case may be). Entrants consent to their personal information being added to the Promoter’s marketing database and the Promoter may, until such time as you request your personal information be removed from our database, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Promoter's Privacy Policy at https://www.rockwear.com.au/privacy-policy

Entrants should direct any request to access, update or correct their personal information to the Promoter via customer service, the instore staff team or through their Rockwear account. All personal information of entrants will be stored at the offices of the Promoter. Upon the entrant’s request, all personal information provided will be removed from the active database. Personal Information will be removed as soon as reasonably possible in accordance with the Promoter's Privacy Policy and applicable laws. 

Item 13: Other Conditions

If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the Promotion.

Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these terms and conditions; (f) any tax liability incurred by a successful entrant and/or (g) the Prizes or use of the Prize.

Item 9: Prize

The Prize is a $500 shopping spree at Rockwear, Midland Gate for the winner and a friend. The winner and friend will each be gifted $500 worth of product on attending Rockwear Midland Gate and must attend the store on the same day and time. The time and date of attending the store is to be organised prior with Rockwear team.
